1. Agreement and scope
These Terms govern use of this website and services provided by Peak Lights ("Peak," "we," "us," or "our"). By using the website, requesting an estimate, approving an estimate, or purchasing services, you agree to these Terms and any project-specific documents you approve.
2. Estimates and pricing
New holiday-lighting projects currently generally start at $1,500. This is a starting minimum, not a quote. Final pricing depends on measured footage, design, access, materials, roof conditions, specialty decor, equipment, and other site factors. A written estimate states the approved scope and price. An estimate request or appointment does not obligate either party to proceed.
3. Approval, deposits, and payment
When a project is accepted, the approved estimate may be converted to an invoice. Unless the written estimate states otherwise, a 50% payment reserves production capacity and the remaining balance is due upon completion or under the due date shown on the invoice. Taxes and approved changes may be added where applicable.
We may offer a secure method to keep a payment card on file. A stored card will be charged only as authorized by the customer, the approved estimate, invoice, or a separate written agreement. We do not enroll customers in automatic recurring billing unless that arrangement is clearly disclosed and separately accepted.
4. Managed seasonal service and ownership
Unless a written estimate expressly says otherwise, the lighting, wire, clips, timers, wreaths, bows, garland, and related decor supplied by Peak remain Peak property. The customer is purchasing a managed seasonal service that may include design, installation, ordinary in-season maintenance, takedown, and storage. Payment for service does not transfer ownership of Peak equipment.
5. Property access and customer responsibilities
- The customer confirms authority to approve work at the property.
- The customer will provide safe, timely access to installation areas, gates, driveways, and functioning exterior power.
- The customer will disclose known hidden wiring, irrigation, fragile surfaces, structural concerns, restricted areas, pets, or other hazards before work begins.
- The customer is responsible for ensuring other contractors or occupants do not move, alter, or damage the installation.
6. Scheduling, weather, and route efficiency
Installation and service dates may be provided as a date or arrival window. Weather, site safety, material availability, daylight, traffic, and efficient geographic routing may require changes. Exact arrival times are not guaranteed. We will make reasonable efforts to communicate material schedule changes.
7. Safety and changes in scope
Peak may pause, modify, or decline work that cannot be performed safely. Lifts, specialized access, roof anchors, harness-required work, repairs, structural preparation, or customer-requested changes outside the approved scope may require a separate charge and approval before work proceeds.
8. In-season maintenance
Ordinary maintenance for a Peak-supplied seasonal display is included only when stated in the estimate. Customers should report issues promptly and avoid modifying the display. Response timing depends on weather, safety, crew availability, and severity. Temporary outages and effects caused by power loss, GFCI trips, severe weather, animals, third parties, or property conditions cannot always be prevented.
9. Cancellations, rescheduling, and refunds
Cancellation, rescheduling, credit, and refund terms are governed by the approved estimate and invoice. Amounts covering completed work, reserved production capacity, nonrecoverable processing costs, custom or allocated materials, and other incurred costs may be nonrefundable to the extent allowed by law.
10. Communications, calls, and SMS
We may contact you about estimates, appointments, project status, invoices, service requests, and other transaction-related matters using the information you provide. Where you separately opt in to marketing texts or emails, consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to end marketing texts and HELP for help. Calls may be recorded or transcribed for quality, training, and accurate project notes when appropriate notice is provided.
11. Photos and marketing
We may document completed work for quality, operations, and project records. We will use identifiable customer or property images for advertising or testimonials only with appropriate permission or where otherwise permitted by law.
12. Website use and intellectual property
Website copy, branding, design, photos, and other content owned by Peak may not be copied, republished, or used commercially without permission. Third-party links are provided for convenience; Peak does not control those sites or their practices.
13. Warranties and limitations
We will perform services in a professional manner consistent with the approved scope. Except for express promises in a written estimate, services and the website are provided without additional warranties to the fullest extent allowed by law. Peak is not responsible for indirect or consequential losses, loss of use, or conditions outside its reasonable control. Nothing in these Terms limits rights or remedies that cannot legally be limited.
14. Governing law and disputes
These Terms are governed by New Hampshire law. Before starting formal proceedings, each party agrees to make a good-faith effort to resolve a dispute by contacting the other party and sharing enough information to evaluate the issue. Any venue will be in a court with proper jurisdiction in New Hampshire, unless applicable law requires otherwise.
15. Privacy and changes
Our Privacy Policy explains how we handle personal information. We may update these Terms as the website and services evolve. The date above identifies the latest version; project-specific changes apply only when agreed in writing.
